KOLENCHERY: The Kerala High Court on Friday October 4, 2013 upheld the Ernakulam District and Sessions Court’s order that Fr Jacob Kurien, the Orthodox faction vicar of the St Peter’s and St Paul’s Church, Kolenchery, is entitled to the keys of the church.
A Bench of Justice T R Ramachandran Nair and A V Ramakrishna Pillai passed the judgment, while disposing of an appeal that challenged the lower court’s ruling.
The appeal was filed by K S Varghese, V M George and C K Thampi from Patriarchal faction against the Ernakulam District and Sessions Court’s order of 2011. The Sessions Court had held that the 1995 Supreme Court judgment had approved the 1934 constitution of the Orthodox faction. The Apex Court verdict was applicable to the Kolenchery church as well.
The session’s court had observed that the Patriarch’s group could not contend that the 1934 constitution was invalid. Dismissing another plea to frame a scheme for the administration of the church, the Session’s Court held that the issue for a scheme did not arise in view of the Supreme Court’s verdict on the 1934 constitution.
On Sunday, October 6, 2013, the supreme head of Malankara Orthodox Church HH Baselios Marthoma Paulos II will celebrate Holy Qurbana in the re-opened St. Peter’s & St. Paul’s Orthodox Church Kolenchery.
